Brothers and Sisters of Wencil Rigel,
left $5 Each, Contest Will

A district court jury was being impaneled before Judge A. B. Clark Thursday to hear an action brought by brothers, sisters, nieces and nephews of the late Wencil Rigel of College township, who died June 8, 1934, to set aside an instrument admitted to probate in district court as Rigel's will.

Under the document a farm was bequeathed to Leo Rigel, a son of William Rigel, a deceased brother of Wencil Rigel. Brothers and sisters were allotted $5 each and the balance of the estate was left to a number of nieces and nephews. Defendents are named as Leo Rigel and the Swisher Trust and Savings bank as executors, Leo Rigel individually, and others. The plaintiffs aver that the will was presented to Wencil Rigel on May 30 (illigible) lacked testamentary capacity as a result of having undergone a major operation the previous day.

The plaintiffs also assert undo influence and maintain that Mr. Rigel did not sign the will in the presence of all the attesting witnesses. The defendents deny the allegations. The protesting heirs ask that Rigel be adjudged to have died intestate, the executors appointment be effaced and appointment of an administrator made

The plaintiffs are Anton Rigel, Mary Vaverka, Frank Rigel and Kate Hudrlik, brothers and sisters , and George Vaverka, Mrs. Alice Petrick, Mrs. Emma Konasek, William Vaverka, Edward Vaverka, George Rigel, Leonard Rigel, Alvin Rigel, Emil Rigel, Leo Rigel, son of Anton Rigel, and Lester Rigel, nephews and nieces.
